Waiver and Release of Liability:

1. Acknowledgement of Risk:

I, understand and acknowledge that participating in basketball training, exercises, games, and other activities at Elite Hoops Academy involves inherent risks of physical injury. These risks include, but are not limited to, sprains, fractures, overuse injuries, heat-related injuries, and in rare instances, more severe injuries such as cardiac events or catastrophic injuries.

2. Assumption of Risk

I knowingly and freely assume all such risks, both known and unknown, even those arising from the negligent acts or omissions of others, and assume full responsibility for my participation at Elite Hoops Academy™.

3.  Waiver and Release:

I hereby release, waive, discharge, and covenant not to sue Elite Hoops Academy, its officers, directors, coaches, trainers, employees, volunteers, agents, and facilities used (collectively, "Releasees") from any and all liability to me, my personal representatives, assigns, heirs, and next of kin for any and all claims, damages, demands, losses, or causes of action arising out of my participation in Elite Hoops Academy™ activities, including, but not limited to, those caused by the negligent acts or omissions of any or all of the Releasees.

4. Medical Treatment:

I give consent to Elite Hoops Academy™ and its representatives to seek emergency medical treatment for me/my child in case of injury, accident, or illness during my/my child’s participation. I understand that I will be financially responsible for any costs of such treatment.

5. Fitness to Participate:

I declare that I am physically fit and have no medical condition that would prevent my full participation in Elite Hoops Academy™ activities.

6. Media Release:

I grant Elite Hoops Academy™ the right to photograph and/or record me/my child in connection with Elite Hoops Academy™ and to use the photo and/or recording for promotional purposes.

7. Acknowledgment of Understanding:

I have read this waiver and release of liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

Elite Hoops Academy™ Payment Policy and Agreement

1. Introduction This Payment Policy and Agreement outlines the terms and conditions regarding the fee structure, payment schedules, and related policies for Elite Hoops Academy™. By enrolling in our programs, you agree to these terms as outlined below.

2. Fee Structure

• Membership Fees: The cost of membership at Elite Hoops Academy™ is between $129.99 and $339.99 per month, depending on the membership selected.  The fee is recurring and will be automatically charged to your designated payment method until you cancel your membership.
  • The membership fee includes access to facility, foundational and advanced 'skills & Drills'
  • Additional costs, for Vertimax training, shooting clinic and other special classes are not included in the membership fee and will be communicated separately.
• Additional Costs: There may be a signup fee which can be waived. This fee is typically $25- $45

3. Payment Schedules

• • Recurring Payments: Your membership fee will be automatically charged on a monthly basis. The charge will occur on the first day of each month.
  • Cancellation: You may cancel your membership at any time. To avoid the next billing cycle's charge, cancellations must be made at least 30 days before your scheduled renewal date.
  • Non-Renewal and Rejoining: If you choose not to renew your membership or if your membership is canceled, you may rejoin at any time, subject to the then-current membership rates and terms.
• 4. Late Payment Policy

5. Refund Policy

• Policy Statement: Elite Hoops Academy™ maintains a strict no-refund policy. All payments made to Elite Hoops Academy™ for membership fees, program enrollment, events, and other services are non-refundable.

  Details of the No Refund Policy:

  1. Membership and Program Fees: Once paid, membership and program fees are non-refundable under any circumstances, including non-attendance, cancellation, or any other reasons.

  2. Events and Special Programs: Fees paid for special events, workshops, or any other activities organized by Elite Hoops Academy™ are not eligible for a refund.

  3. Acknowledgment: By enrolling in and making payments for any programs, events, or services at Elite Hoops Academy™, participants, and their guardians (if applicable) acknowledge and agree to this no-refund policy.

  Exceptions: This policy is subject to the law and may be overridden by statutory consumer rights under certain legal jurisdictions.

Purpose:
The purpose of this policy is to ensure a safe, respectful, and productive environment for all members and athletes at Elite Hoops Academy. This policy outlines the expectations for behavior and use of the facility, and the consequences for non-compliance.

Scope:
This policy applies to all athletes, members, coaches, staff, and visitors at the Elite Hoops Academy facility.

General Rules and Expectations:

1. Respect for Property: Members must treat all facilities and equipment with respect and care. Vandalism or misuse of property will not be tolerated.
2. Safety First: Prioritize your safety and the safety of others. Follow all guidelines and instructions provided by coaches and staff. Proper athletic attire must be worn at all times.
3. Cleanliness: Keep the facility clean and tidy. Dispose of trash in the designated bins and return equipment to its proper place after use.
4. Sportsmanship: Display high standards of sportsmanship, respect, and fair play. Harassment or bullying of any kind is unacceptable and will be dealt with severely.
5. Punctuality: Arrive on time for sessions and events. Late arrivals disrupt sessions and may lead to limited participation.
6. Compliance with Staff Instructions: All members must follow the instructions of the coaching staff and facility management. Disobedience or disrespect towards staff will not be tolerated.

Consequences of Non-Compliance:
Violation of any of these rules may result in disciplinary action, up to and including temporary suspension or permanent revocation of facility access, depending on the severity of the offense. Specific consequences include:

• First Offense: Verbal warning and notation in the member’s record.
• Second Offense: Written warning and possible suspension from the facility for a period determined by the management.
• Subsequent Offenses: Potential permanent revocation of facility access and membership termination.

Reporting Violations:
Members are encouraged to report any violations of these rules to the facility staff or management. All reports will be taken seriously and investigated promptly.

Acknowledgment of Policy:
All members, athletes, and staff are required to acknowledge that they have read, understood, and agreed to adhere to this Facility Use Policy.
